Büdelsdorf, 17/10/2006 - mobilcom AG has today concluded a settlement
with yet another of the plaintiffs who had filed a challenge to the
merger resolutions of the Extraordinary General Meeting 2005.
The conclusion of the settlement was determined today by the Kiel
Regional Court. Together with the previous partial litigation
settlements of 17 August 2006 and 25 August 2006, the company has now
concluded settlements with 22 of the 24 plaintiffs of the originally
pending actions and with all four of the third parties intervening in
support of the plaintiffs.
The fast track procedure with the two remaining plaintiffs will be
continued before the Higher Regional Court Schleswig. Nevertheless,
the company will continue to seek an out of court settlement with the
two remaining plaintiffs, as will freenet.de AG with the remaining
plaintiff in its case.
